conditions and stipulations:
All bids must contain a valid method of electronic and/or telephonic
contact as well as the bidder's full name and mailing address.
Sealed
bids will be accepted by hand delivery, by United States Postal
Delivery, or by any recognized courier service until 17:00 CDT (5:00
o'clock in the evening, local time) Friday, 12 June, 2008. Bid

- All bids will be reviewed in closed
session of
the regularly scheduled Western Cherokee Nation Tribal Council Meeting
on or about 13 June, 2008. Preference will be given first to
bids of
Citizens of the Western Cherokee Nation and then to the general public
and other participating entities.
- Lobbying of any council person or
persons for the
purpose of encouraging the acceptance of any particular bidder's
submission is prohibited and will result in the possible
disqualification of said bid or bids.
- The Western Cherokee Nation Tribal
Government
reserves the right to accept, reject and/ or decline any or all bids
without explanation and/or justification. Submitters of declined bids
will not be notified of the decision of the Tribal Council.
- No Officers nor Members of the Board
of
Directors, nor the immediate family members of same residing in the
same household, of the non-profit Missouri corporation WESTERN CHEROKEE
may bid on the above described item pursuant to Internal Revenue
Service regulations concerning the operations and the governance of a
501(C)(3) corporation.
- Upon bid acceptance, the non-profit
Missouri
Corporation WESTERN CHEROKEE shall be directed to deliver Clear title
and proper bill of sale to the accepted bidder upon delivery of cash or
certified funds in accordance with the terms of the acceptance of the
bid. Acceptance of bid by the Western Cherokee Nation's Tribal
Council
constitutes a binding agreement between the accepted bidder and the
non-profit Missouri Corporation WESTERN CHEROKEE; Specific performance
is demanded in advance and said transaction shall be completed within
five calendar days of notification of acceptance of bid.
- The afore-described item shall be
picked up from
the Western Cherokee Nation's Tribal Capitol Complex no later than ten
(10) business days after conclusion of transaction. Storage fees
will
be assessed beginning the day after the expiration of aforementioned
time at a rate of twenty dollars (US) ($20.00) per calendar day;
maximum storage time is sixty (60) calendar days in aggregate prior to
disposal of property.
